Bethesda has issued a public response to yesterday's decision by the ESRB to upgrade the rating on The Elder Scrolls IV: Oblivion from "Teen" to "Mature".

"Bethesda Softworks made what it believes was a full, accurate, and comprehensive submission on Oblivion to the ESRB months before the game’s release. Bethesda used the ESRB’s application forms and believes it adhered closely to their requirements. Nothing was hidden from the ratings agency. No effort was made by Bethesda to lobby or influence the agency for any particular rating."

ESRB Re-rates Oblivion With M Rating For Nude Content E-mail
General Gaming News Bits
Written by Rivithed
Wednesday, 03 May 2006
The ESRB re-rates Oblivion with a Mature rating (see pdf from ESRB here), up from a Teen rating, stating that Bethesda failed to report objectionable material in ratings submission.

As a result of "more detailed depictions of blood and gore than were considered in the original rating, as well as the presence of a locked-out art file or 'skin' that, if accessed through a third-party modification to the PC version of the game, allows the user to play with topless versions of female characters."

Among the corrective actions that Bethesda Softworks will be promptly undertaking are:
- Immediate notification to all retailers of the change in rating, along with a request to adhere to their respective store policies not to sell the newly rated M (Mature) game to those under the age of 17, and explaining how to address consumer concerns;

- Issuance of stickers with the new rating information to all retailers and distributors to affix on the packaging of all existing unsold inventory;

- Display of the newly assigned M (Mature) rating in all future product shipments and marketing materials;

- Creation and posting of a downloadable patch that will modify the art archive, rendering the topless skin inaccessible on the PC version of the game.

See our earlier report on the nude-mod here. Guess its going to be tough on Bethesda hitting the sales it was before.

"Mercenaries 2: World in Flames" will be following-up Pandemic's original Mercenaries. We thought something was cookin' earlier when a mysterious web site popped up. Pandemic Studios today announced that the nex-gen sequel to the sandbox "Playground of Destruction" will take place in a new location from the previous game.

"While the original Mercenaries' high-octane, go anywhere, do anything and blow the crap out of everything style was a hit with gamers, the whole experience was screaming to run on next-generation game systems," said Pandemic CEO Andrew Goldman. "And while we're building on the core mercenary experience we created for the original, we've taken full advantage of next-gen technology to offer a more richly detailed, reactive, living world than gamers have ever seen before."
